It is possible to refuse vaccinations in the maternity hospital

It is possible to refuse vaccinations in the maternity hospital

You should know that Federal Law No. 157 “On Immunoprophylaxis of Infectious Diseases” states: citizens have the right to refuse vaccinations (Article 5), and vaccinations for minors are carried out only with parental consent (Article 11). Only in many maternity hospitals they may not even inform you about your child’s vaccination. That is why you need to be on guard when registering in the maternity ward.

The Law “On Immunoprophylaxis...” states that vaccinations are carried out for citizens who do not have medical contraindications (Article 11). But it is worth noting that there is no way to determine in advance the presence of such contraindications in the first 12 hours of a baby’s life.

The child's health in the first days after birth is unknown. The child adapts to life outside the mother. It is actually possible that trauma, intrauterine infection, etc. may go undetected immediately after birth. But a vaccination given in such a case can lead to serious consequences.

Then how can you protect your child? This is quite feasible even in a maternity hospital, because all vaccinations can now be refused by law. To do this, you need to write an application to refuse vaccinations in advance, in two copies, and stick it to the card that was given to you at the antenatal clinic. You should have a second copy of the application in hand when you are in the postpartum ward.

Attention, so that your application does not get “lost”, write on the front page of the card: “I refuse all vaccinations for my child, I am enclosing a statement of refusal” and put your signature. It is advisable if both the card and the application also have the signature of the child’s father. Warn the doctors about your refusal verbally, upon admission to the maternity hospital, and after childbirth. Don't be afraid that you will be treated poorly during childbirth because you refused to be vaccinated. After all, obstetricians deliver babies, not give birth.

You should know that doctors are given “plans for vaccination work” from above. There are sanctions for failure to comply, so they will try to persuade you to get vaccinated.

To do this, various “tricky things” are used:

  • Do not sign any paperwork without reading it completely. After all, it may be that along with various medical interventions during childbirth, to which you may be asked to agree, vaccinations of the baby will also be included. Then you need to cross this item off the general list.
  • You should not be afraid of the fact that severe psychological pressure may be exerted on you. You may be intimidated by hepatitis B and tuberculosis. It is useless to argue, since they are interested in vaccination, but if you still want to argue, you can give the doctors the following arguments in response: in our family there is an allergy, vaccination against hepatitis B can be done with a genetically modified vaccine. And BCG is a live vaccine, but where are the guarantees that my baby’s immunity is fine and there will be no complications, etc.
  • It is possible that you will be told that it is impossible for you to be discharged from the maternity hospital without BCG. Please be aware that this is against the law. No one has the right to keep you in the maternity hospital. At any time, if you wish, you can take the baby and go home after giving birth. The only thing doctors can do is ask you for a signature stating that you take full responsibility for the consequences. In your case, focus on the “Fundamentals of the legislation of the Russian Federation on the protection of the health of citizens,” Article 33 gives you the right to refuse all medical intervention. Know that the provision of medical care or hospitalization without the patient’s consent takes place only by court decision. And then only if the patient has dangerous infectious or mental diseases.
  • If you refuse BCG, you will probably be asked for a certificate from the tuberculosis dispensary stating that there are no tuberculosis patients who can be registered at your residence address. So this requirement is illegal. Once upon a time, there may have been such instructions from the Ministry of Health, but with the release of the law “On Immunoprophylaxis of Infectious Diseases,” all of them are no longer valid.

If you are giving birth for a fee, then demand that the following clause be included in the contract: “The medical service provider (maternity hospital) undertakes not to vaccinate the child against hepatitis. B and tuberculosis (BCG), and at the same time guarantees the unhindered discharge of the mother and child from the maternity hospital without requiring any certificates from the tuberculosis dispensary.”

In any case, if you think you should refuse vaccinations, go all the way without fear. And if you have not yet come to a final decision, then do not rush to conclusions, but first find out more about upcoming vaccinations, the drugs used and other important information.

On the contrary, I was glad that I got vaccinated while still in the maternity hospital. They did BCG and hepatitis. This is much more convenient than going to the clinic with your baby later. You first have to go to an appointment with a pediatrician, then stand in line at the vaccination office. The baby may want to eat, may poop, and will need to urgently change the diaper. In addition, sick children go to the hospital and there is a risk of contracting colds. Do you need this? I recommend getting vaccinated while still in the maternity hospital.

At the maternity hospital I signed permission only for the BCG vaccination. I think that it still needs to be done. But I wrote a refusal for hepatitis B. The most interesting thing is that permission for vaccinations is usually required immediately after the birth of the child. That is, I just gave birth, and the doctors are already slipping papers. I think many women at the moment can sign anything without hesitation.

Home / Vaccines / Tips: “in the maternity hospital” - refusal to vaccinate newborn children /

If you ended up in a maternity hospital, and did not give birth at home in the water as our ancestors did, then:

In accordance with Federal Law No. 157 “On Immunoprophylaxis of Infectious Diseases”: citizens have the right to refuse vaccinations (link) (Article 5), and vaccinations for minors are carried out only with parental consent (link) (Article 11). But sometimes in maternity hospitals, contrary to the law, they not only don’t ask for consent, but don’t even inform them about the child’s vaccination! Therefore, be alert when going to the maternity hospital. Your task is to protect the newly born baby at all costs from dangerous interference in the tiny body... According to the law “On Immunoprophylaxis...”, vaccinations are carried out for citizens who do not have medical contraindications (Article 11), but it is obviously impossible to determine the presence of these contraindications in the first place. 12 hours of a child's life! For the first few days after childbirth, the child’s health status remains unclear, adaptation to life outside the mother occurs, and trauma, intrauterine infection, etc. may appear unnoticed immediately after birth. A vaccination given in such a situation can have very serious consequences.

How to protect your children? Even in a maternity hospital, this is quite possible, since all vaccinations, and indeed any medical interventions that do not suit you, can now be refused by law. Write a statement in advance to refuse vaccinations (in two copies) and stick it to the card issued by the antenatal clinic, which you will take with you to the hospital. The second copy of the application must be in your hands when you are in the postpartum department. To prevent your application from being “lost”, you should write directly on the front page of the card in red ink: “I refuse all vaccinations for my child, I am enclosing a statement of refusal” and sign it. It is highly desirable that both the card and the application also have the signature of the child’s father. Do not forget to warn doctors about your refusal also verbally, both upon admission to the maternity hospital and after childbirth. You should not be afraid of a bad attitude towards you during childbirth due to refusal to vaccinate; vaccinations are not carried out by obstetricians who deliver the baby, but by pediatricians with whom you will deal afterward.

Remember that doctors are given so-called “vaccination work plans” from above, failure to comply with which is followed by various sanctions, so they will try to persuade you to agree to vaccinations. For this, certain tricks can be used: - Under no circumstances sign any papers offered to you by the maternity hospital staff without reading them completely.

There have been cases when, among all kinds of medical interventions during childbirth, to which you are asked to consent, vaccination of the child is also listed. Cross this item off your list.

- Be prepared for the fact that very severe psychological pressure may be exerted on you; you will be sophisticatedly intimidated with hepatitis B and tuberculosis. It’s better not to get into arguments with doctors, and you don’t need this hassle, and it’s still pointless to prove anything to them, since vaccination is an integral part of their job responsibilities. If you still decide to argue, you can use the following arguments: our family has allergies, the hepatitis B vaccine is a genetically modified vaccine, BCG is a live vaccine, which guarantees that my child’s immunity is fine and there will be no complications, etc. P.

— They may also tell you that they do not have the right to discharge you from the maternity hospital without BCG. This is a gross violation of the law! They have no right to keep you in the maternity hospital! If you wish, you can take the baby and go home at any time, even immediately after giving birth; the most that doctors can do is ask you to sign that you take responsibility for the consequences of your care. Refer to the Fundamentals of the Legislation of the Russian Federation on the Protection of Citizens’ Health,” Article 33 guarantees you the right to refuse medical intervention. Remember that the provision of medical care or hospitalization against the will of the patient is possible only by court decision and only if the patient suffers from a particularly dangerous infectious disease (such as the plague or SARS) or mental illness.

— If you refuse BCG, you may be required to provide a certificate from the tuberculosis dispensary stating that there are no tuberculosis patients registered at your residence address. This requirement is illegal! If such instructions from the Ministry of Health once existed, then with the passage of the law “On the Immunoprophylaxis of Infectious Diseases”, all of them, as being contrary to federal legislation, became invalid. Of course, if you have the time and desire, you can get such a certificate from the tuberculosis clinic in advance and take it with you to the maternity hospital. But be prepared for the fact that doctors, wanting to vaccinate your child at all costs, will reject this certificate, finding fault with the little things in the style of its execution, for example, the stamp was put in the wrong place, the wrong doctor signed, etc., and etc. Therefore, it is better not to waste time, but to insist in the maternity hospital on compliance with the law. Please note the attached letter from the St. Petersburg Health Committee, which states that it is prohibited to require certificates from tuberculosis clinics in maternity hospitals. (p.23)

If you are giving birth for a fee, under an agreement with a maternity hospital, demand that the following clause be included in this agreement: “The medical service provider (maternity hospital) undertakes not to vaccinate the child against hepatitis B and tuberculosis (BCG), and at the same time guarantees unhindered

I discharge the mother and child from the maternity hospital without requiring any certificates from the tuberculosis dispensary.” If you are hesitant about whether or not to vaccinate your child, try to at least protect him from the introduction of a low-quality vaccine, from ignoring medical contraindications to vaccination, and from doctors avoiding responsibility in the event of, God forbid, a post-vaccination complication. Let them sign a letter of guarantee confirming that the vaccine has a quality certificate, that the child has been examined and no contraindications have been identified, and that in the event of a complication, doctors will bear financial responsibility. Unfortunately, there have already been many cases when the parents of a child who became disabled as a result of vaccination and in need of very expensive treatment were left without any help from the state, and the doctors who forced them to undergo this vaccination turned out to have “nothing to do with it.” Well, what to do if your child was vaccinated in the maternity hospital without your knowledge and consent? Firstly, stop and prevent further administration of genetically modified poison to him (remember, the hepatitis B vaccine is administered three times - after birth and at the age of 1 and 6 months). Do not listen to the assurances of incompetent doctors that “the chain of vaccinations cannot be interrupted.” In principle, there can be no harm to health from this. The sooner you stop, the less poison your child will receive. Secondly, be sure to write a complaint to the prosecutor’s office listing the articles of law violated by the maternity hospital staff, and send it there by registered mail. A minimum of hassle for you, but a certain amount of trouble for the frustrated vaccinators. So, you see, they will think about respecting human rights, and this arbitrariness and violence committed against people for their own money, which in the form of considerable taxes goes to finance the system of providing medical services, will stop. AND LASTLY, you are becoming a mother, which means you must be ready to fight for the interests of your child. Now it will become an integral part of your life, and, of course, not only in relation to vaccinations. it is necessary to take into account that outsiders, including doctors, the interests of your child are at best indifferent, and, moreover, may even contradict their own. Remember that staying in the maternity hospital is only a week, and for the sake of preserving the health of the child, the rudeness and threats of doctors can be tolerated. while your cowardice and momentary weakness can be very costly for your baby. After all, the poison that was injected into him precisely when his fragile body was so vulnerable and defenseless cannot be pumped back out.

Registration of an official refusal of vaccination in the maternity hospital

According to the law “On Immunoprophylaxis...”, vaccination is carried out to persons who have no medical contraindications (Article 11). Meanwhile, in the first day of a child’s life, it is difficult to say unequivocally that the newborn does not have health problems such as intrauterine infections or hidden birth injuries. In these cases, vaccination may place additional unwanted stress on a fragile body. In connection with this law, it is possible for parents to refuse vaccination if for any reason they wish to postpone or not do it.

Parents must write an application for refusal of vaccination in the maternity hospital in two copies, put 2 signatures on them - the father and mother of the child

Parents must write an application for refusal of vaccination in any form addressed to the maternity hospital staff. It is better to take care of this before the birth, in order to inform the maternity hospital staff about your decision in advance . This must be done in duplicate. One of them is attached to a medical card, which the woman in labor takes with her to the maternity hospital. It is recommended that the young mother keep the second copy with her when she is transferred to the postpartum ward.

It is important that the application has the signature of one, or preferably both, parents.

Doctors say that timely vaccination directly sharply reduces the likelihood of contracting hepatitis B in the long term and, therefore, reduces the long-term risk of cirrhosis and liver cancer. But the final decision on the advisability of any vaccination for a newborn remains with the parents.

Is it worth getting vaccinated against hepatitis in the maternity hospital?

More and more parents are asking the question about the advisability of vaccination against hepatitis in the maternity hospital. As a result, when making their own decision to refuse vaccination, they are guided by facts that are obvious, in their opinion, such as the low probability of infection of the baby if there is no carrier of the virus in the immediate environment. And such routes of infection as sexual or injection are irrelevant for a small child.

But doctors give additional arguments:

  • The disease can occur in a latent form. Carriers of the hepatitis B virus who are not sick themselves are nevertheless infectious to others.
  • Infection can occur at a dentist's appointment, when ears are pierced in a beauty salon, and under certain circumstances - even in kindergarten or school. Let us remind you that the virus survives in the environment for up to 2 weeks, being inside dried blood cells.
  • The declared validity period of a vaccine is most often at least 20 years (depending on the name of the vaccine and the characteristics of a particular organism). This means that protection from a dangerous disease will be provided to your child during puberty and the beginning of an independent life, including sexual life. If infection does occur, the vaccine prevents the disease from becoming chronic, which is the main threat to liver health.

Maybe only children from sick mothers should be vaccinated on the 1st day?

Why do parents refuse hepatitis B vaccination on the 1st day and postpone it to a later date? They usually say that they do not want to burden the baby’s immune system immediately after birth. Moreover, if the risk of their child contracting hepatitis is very low. Many people ask a justified question: “I don’t have hepatitis B, so why would I vaccinate my child against this disease on the first day? After all, I couldn’t infect him.”

Yes, these arguments are quite logical, but they are too weak. Unfortunately, laboratory tests can make mistakes and “give” a false negative result during pregnancy (according to various sources, from 2 to 8%). Accordingly, there is a risk that an unvaccinated child will get hepatitis B because his mother was infected with a dangerous virus, but did not know about it. There is still a risk of contracting hepatitis in the later stages of pregnancy, after the negative results of all examinations have been entered on the exchange card. If all these mothers (with a false negative test result) refuse vaccination in the maternity hospital, then 17,000-20,000 newborns will be infected with hepatitis B annually! And none of the children are insured that they will not be included in their number.

It is especially offensive when mothers who are healthcare workers refuse vaccination, citing the fact that they do not have hepatitis B, as they undergo medical examinations every year. They do not refuse vaccination completely, they simply postpone it to a later date. Are they right? Of course not. It is medical workers who are at risk for contracting hepatitis B, and there is no guarantee that this infection will not occur during pregnancy.

In addition, on the 1st day of life, no doctor can know complete information about the child’s health status. Thus, an apparently healthy child may have severe malformations of internal organs that will require surgical intervention. A child may become ill during the neonatal period or in the first months of life, which in some cases will require transfusion of blood components. That is, any child may find himself in such a situation that he will be at risk of contracting hepatitis B at a very early age. Therefore, the task of parents and doctors is to provide protection from a dangerous enemy.
